A vacant parcel can look ready to build and still have a costly problem hiding between zoning, floodplain review, foundation design and the building permit. That matters even more now because Weld County adopted an updated building code that took effect June 15, 2026.
The update applies in unincorporated Weld County. Property inside Ault, Eaton, Nunn, Greeley or another incorporated town or city may be governed by that municipality's rules instead. Confirm the jurisdiction before relying on any permit advice or construction estimate.
1. Zoning review comes before the building permit
Weld County now expressly requires a zoning compliance review before a building permit is issued. A building plan can meet construction standards and still conflict with the parcel's zoning, setbacks, lot history or approved land-use conditions.
For a rural buyer, this means “there is plenty of room” is not an answer. Identify the proposed house, shop, arena, barn or manufactured home on the parcel and check the use and location with Planning before treating it as feasible.
2. Most new structures may need an engineered foundation
The county says the updated code requires engineered foundation designs for most new structures, with exceptions for certain additions, detached garages and pole buildings. The exception is not something to assume from a listing description or a contractor's rough quote.
Foundation engineering can affect design, timing and cost. On a property with expansive soils, slope or drainage issues, the difference between a generic building price and a buildable plan can be substantial.
3. Agricultural and accessory buildings still need a permit check
The 2026 update changed permit requirements and exemptions for agricultural buildings, accessory buildings, cargo containers and utility structures. Calling a structure a “barn” or “ag building” does not automatically settle whether it is exempt, where it may sit or what documentation is required.
Before ordering a kit, pouring concrete or advertising land as ready for a large shop, confirm the proposed size, use, utilities and location with the county. An exempt structure may still be subject to zoning, floodplain or other site rules.
4. Floodplain review can stop work before construction begins
The updated code clarifies that floodplain review must occur before construction begins in a designated flood-hazard area. This is not limited to land with standing water or an obvious creek. A mapped floodplain can cross only part of a large acreage parcel and still affect the best-looking building site, access route or septic layout.
Check the actual proposed improvement area—not only whether some portion of the parcel touches a floodplain.
5. Manufactured homes and expired permits have new rules
Weld County added standards and definitions for manufactured homes, modular homes, mobile homes and manufactured structures. It also added a process for re-permitting projects when a permit expires before the work is complete.
Buyers should not assume every factory-built home is treated the same. Sellers should also disclose unfinished permitted work and verify whether an old permit is active, expired or needs to be reopened.
What this means when buying vacant land
A strong due-diligence period should give the buyer time to verify more than well and septic. Before closing, work through this order:
- Confirm whether the parcel is in unincorporated Weld County or inside a municipality.
- Verify that the parcel is a legal lot and identify its zoning.
- Sketch the proposed improvements, driveway, well and septic area.
- Check setbacks, floodplain and any recorded building envelope or easements.
- Ask the county what zoning and building reviews apply to that specific plan.
- Price foundation engineering, power extension, water and wastewater before finalizing the budget.
What this means when selling
A seller does not need to design the buyer's project. But a clean package showing jurisdiction, zoning, access, utility location and known floodplain conditions is more useful than saying “build whatever you want.” If the property is being marketed for a home, shop or agricultural use, make the claims specific enough to verify.
The best time to find a permitting problem is before the land is priced around an improvement that may not work.
